Suspension of a citizen’s right to operate a motor vehicle as an administrative sanction

Abstract
The paper examines the evolution of administrative-legal regulations in Georgia in restricting the right to operate a motor vehicle and their compliance with international legal practice. In 2024, the Service Agency began issuing international driving permits, ensuring the legal mobility of Georgian citizen drivers abroad and compliance with the requirements of the Geneva Convention on Road Traffic and the Vienna Convention on Road Traffic. The study pays particular attention to the 2013 legislative amendment, according to which the suspension of the driving right replaced the administrative sanction of revocation of the right to drive. It is noteworthy that revocation implied the complete termination of this right, and its restoration was associated with complex legal and administrative procedures. Suspension represents a temporary restriction to correct the offender’s behavior and prevent further offenses. The paper analyzes the current regulations, including the functioning of the points system, sanctions for driving under the influence of alcohol, and special guarantees for people with disabilities. It also discusses the legislative amendments of 2025–2026, concerning the simplification of the procedure for restoring driving rights and the improvement of the points system. A comparative analysis based on the examples of the United States, Germany, and Norway demonstrates that temporary suspension and revocation of the driving right are widely used as preventive mechanisms and tools for ensuring road safety.
