Legal analysis of medical professional admission models in the context of patient safety

Abstract

The article discusses the legal analysis of medical professional admission (licensing, certification) models in the context of patient safety and aims to provide a legal assessment of the balance between professional autonomy and state supervision. According to the study, medical professional admission is not considered as a single or isolated legal act, but as a complex regulatory model that combines licensing, certification, continuous professional development (CME/CPD) and administrative responsibility. The study is based on dogmatic and administrative-legal methodology and considers the institution of professional admission as a legal instrument for the implementation of the state's constitutional obligations in the field of public interest and health protection. The paper analyzes professional admission models (licensing, certification) as preventive legal mechanisms aimed at ensuring minimal professional competence. Special attention is paid to the legal nature of decisions on professional admission as individual administrative acts. They are subject to procedural guarantees and legal control. The paper also analyzes the role of continuing medical education and professional development (CME/CPD) in the process of maintaining professional admission and identifies the normative and institutional weaknesses of the current model, which partially limit the potential for effectiveness. The final part of the study concludes that effective patient safety requires a legally integrated and enforceable system of professional access models, in which licensing, certification, CME/CPD, and administrative responsibility function as interdependent and reinforcing components. Such an approach creates the basis for the development of a risk-oriented, preventive regulatory framework and strengthens both the quality of medical services and public trust in the healthcare system.
